When specifying prices for products sold on rakuten.de the general legal requirements regarding advertising product prices must be observed. This includes an obligation to ensure your prices are always up to date and accurate and comply with the principle of 'price reflects cost'. This is particularly relevant when advertising discounted prices (promotions using strikethrough prices) or if you must comply with product-specific pricing requirements (e.g. products for which basic price information must be provided).

When you list an item for sale and a buyer decides to purchase this item from you, you are obliged to sell the item to the buyer at the advertised price, even if you believe the advertised price was incorrect or that the advertised price should not be charged. You are not entitled to cancel a purchase agreement on the basis of incorrect pricing information, except in the case of a legal exemption. You must send the item to the buyer and observe the advertised price.

 

Price including taxes and other pricing information

You are also responsible for collecting VAT and any other applicable taxes from buyers, and advertised prices must include the applicable VAT and any other price components.

It is your responsibility to ensure that you comply with all applicable laws and collect all relevant price components, including VAT and customs or excise duties, and to report and remit such taxes to the relevant tax authorities

 

Information regarding shipping costs

In addition to the price of each item sold on the Rakuten marketplace, you must provide information on any charges for postage, packaging and shipping and how much these costs are. If you offer free shipping, you must inform customers about this.

 

Strikethrough prices

If you use strikethrough prices on Rakuten, you must ensure that your reference prices are always based on actual prices (fictitious prices are prohibited).

The strikethrough price must be a price you previously charged on Rakuten. You are not permitted to advertise a strikethrough price if you did not previously charge that price on rakuten.de.

You are strictly prohibited from advertising a discounted price if you only used the crossed-out reference price for an unreasonably short period of time.

Using a false Manufacturer Suggested Retail Price (so-called MSRP) where there is no MSRP for that product or where the manufacturer never marketed this version of the product is also prohibited. Please ensure that the advertised MSRP is still accurate.

When using strikethrough prices, all relevant legal provisions must be observed.
